Do I need to pay for my insurance?
Absolutely not! At DDS, we've got your back and take care of all insurance costs.
What is the difference between Workers' Compensation and Occupational Accident Insurance (OAI)?
Workers' Compensation is a mandatory insurance program for W-2 employees which provides benefits for work-related injury or illness. This state-regulated program is designed to support workers in returning to work through comprehensive medical benefits, which apply regardless of fault or negligence. It is paid in full by the employer.
OAI is an opt-in insurance program for 1099 independent contractors which provides benefits for work-related injuries due to accidents. The coverage scope is more limited than Workers' Compensation, and benefits may be denied if the contractor is determined to be at fault. Contractors are responsible for paying for their own insurance costs, or premiums may be deducted from their wages depending on their employment contract.
See our article HERE (link) for a more detailed breakdown of the differences.

Taxes
What is my tax classification?
Dental auxiliary staff (hygienists, dental assistants, EFDAs, office staff) are properly classified as W-2 employees. Doctors are properly classified as 1099 independent contractors.
How is my tax classification determined?
The U.S. Department of Labor determines tax classification based on the degree of control and supervision in the work relationship. See our article HERE (LINK TO 1099 article) for a detailed breakdown of their legislation and its application to dental professionals.
What is the difference between W-2 and 1099?
W-2 and 1099 tax classifications are defined by the IRS and determine your tax withholding, insurance contributions, coverage scope, and eligibility for benefits.
Here is a breakdown of the key differences:
W-2 employees are economically dependent on their employers, and therefore are entitled to protection. Employees:
- Receive unemployment and Workers' Compensation benefits paid in full by their employer
- Pay half of Social Security and Medicare contributions, and half paid by their employer
- Have taxes withheld from their paycheck by their employer
1099 independent contractors are economically independent, and therefore have more limited protection. Independent contractors:
- Do not receive unemployment or Workers' Compensation benefits
- Pay the entirety of Social Security and Medicare contributions
- Remit their own taxes to the IRS

Is it illegal for me to be classified as 1099?
It is illegal for dental auxiliary staff to be classified as 1099 independent contractors. 1099 misclassification is a widespread issue which leaves dental professionals vulnerable to financial and legal risk. DDS is W-2 compliant, ensuring our employees are fully protected. See our article HERE for a breakdown of the cost to misclassified employees.
